Caught an MSNBC analyst saying the appt is constitutional. Guess that means that other are still saying that it isn't. Idk, not bothering to research the particulars.

Did look up Matthew Whitaker, though.
After Trump appointed Whitaker as Acting Attorney General, a number of legal scholars, commentators, and politicians questioned the legality and constitutionality of the appointment or called for him to recuse himself from overseeing Robert Mueller's investigation into Russian interference in US elections.
Seems to be more unanimity that recusal is a must.
During his undergraduate years at Iowa, Whitaker played tight end for the University of Iowa Hawkeyes football team, appearing in Iowa's Rose Bowl game in 1991.

Early career

After graduating from law school, Whitaker worked for a number of regional law firms including Briggs & Morgan (Minneapolis) and Finley Alt Smith (Des Moines). He was also corporate counsel for a national grocery company, SuperValu, and small businessman owning interests in a trailer manufacturing company, a daycare, and a concrete supply company.
Couldn't hold a job.
Whitaker ran as a Republican for Treasurer of Iowa in 2002, losing to incumbent Democrat Michael Fitzgerald by 55% to 43%.

United States Attorney

On June 15, 2004, Whitaker was appointed U.S. Attorney for the Southern District of Iowa by President George W. Bush. From 2005 to 2007, he was responsible for the unsuccessful investigation and prosecution of Iowa State Sen. Matt McCoy, a liberal Democrat, on charges of attempting to extort $2000.

Private career and political activities

Whitaker was the co-chairman of Texas Governor Rick Perry's 2012 presidential campaign.
That went well.
Whitaker was a candidate for the Republican nomination in the 2014 United States Senate election in Iowa, a seat being vacated by Democrat Tom Harkin. He came fourth in the Republican primary in June, with 11,909 votes (7.54%). The nomination was won by Joni Ernst, who went on to win the general election.

After losing the Republican primary, Whitaker chaired the campaign of Sam Clovis, another unsuccessful primary candidate who had been selected, later in June, to run for Iowa State Treasurer. Clovis lost in the November 2014 general election.

In 2014, Whitaker became a paid advisory board member for World Patent Marketing. In March 2017, the Federal Trade Commission commenced litigation for fraud. In May 2018, the United States District Court for the Southern District of Florida ordered the company to pay more than $25 million and cease operations. The company donated to Whitaker's 2014 Senate campaign. He received $9,375 between 2014 and 2016 and was owed a further $7,500 at the time the FTC shut down the company. The New York Times reported on November 8, 2018 that court documents show "when frustrated consumers tried to get their money back, Scott J. Cooper, the company’s president and founder, used Mr. Whitaker to threaten them as a former federal prosecutor."

From October 2014 to September 2017, Whitaker was the executive director of the Foundation for Accountability and Civic Trust, and the organization's only full-time employee in 2015 and 2016. FACT, founded in late 2014, is a conservative nonprofit organization specializing in legal and ethical issues related to politics. The Washington Post reported in February 2015 that "The group is backed by $1 million in seed money from donors who support conservative legal causes", and that Whitaker had declined to identify the donors. According to the organization's first tax return, its funding — $600,000 in 2014 - came from a conservative donor-advised fund called DonorsTrust, a pass-through vehicle that allows donors to remain anonymous.

The New York Times' Charlie Savage reported that Whitaker said in a question-and-answer session during his 2014 Iowa Senatorial campaign that "the courts are supposed to be the inferior branch." Whitaker was critical of the United States Supreme Court beginning with Marbury v. Madison (1803), the decision that allows judicial review of the constitutionality of the acts of the other branches of government. In the same interview, he criticized a long line of Supreme Court cases. Harvard Law professor Laurence Tribe described Whitaker's views as “extreme and the overall picture he presents would have virtually no scholarly support,” and they would be “destabilizing” to society if he used the power of the attorney general to advance them."
Marbury v. Madison, the very foundation of our 3-branch separation of powers, really?! It doesn't get any more legally radical and supportive of an imperial presidency than that.

Thank you for taking the time to contact me about the resignation of United States Attorney General Jeff Sessions. I appreciate hearing from you.

As you may know, on November 7, 2018, Jeff Sessions was asked by President Trump to resign from his duties as Attorney General. I worked with Jeff Sessions for two years in the Senate, and he is one of the most decent and honorable people I know. Even though we may not agree on every issue, he led the Department of Justice with integrity. He is a patriot, and is committed to defending the rule of law without political bias or partiality. I and many of my colleagues will miss him, but we wish him best on all his new endeavors.

Following Jeff Sessions’ resignation, President Trump announced that Matthew Whitaker, who served as Chief of Staff to Attorney General Jeff Sessions, would serve as the Acting Attorney General. President Trump also announced that a permanent replacement will be announced at a later date.

I understand there are concerns about Mr. Whitaker’s ability to independently and fairly oversee the investigation into Russian interference in the 2016 election. As I have said many times, I am committed to providing the Department of Justice all of the tools and resources to ensure the investigation continues in a fair and transparent manner. I am one of the lead sponsors of S. 2644, the Special Counsel Independence and Integrity Act, which is a bipartisan bill that creates a judicial-review process to prevent the removal of a special counsel without good cause. In addition, once President Trump nominates a candidate to replace Jeff Sessions. I will seek assurances from the nominee that they will allow the investigation to run its course and reach whatever conclusions the facts dictate.

According to right-wing Faux legal analyst and former Judge Napolito, the legal requirements to be acting AG are: (1) be a current assistant; (2) be in a current position that requires Senate approval; or (3) be appointed during Senate recess.
According to Judge Nap, Trump can't give this guy the job.

So, assuming Nap to be right (big assumption, I know), any action he took or decision made would be subject to challenge on some pretty strong grounds.

... Veteran Supreme Court litigator Thomas Goldstein argues that Whitaker — a Trump loyalist who was appointed to his post by the president last week — cannot take over for ousted Attorney General Jeff Sessions because Whitaker hasn’t been confirmed by the Senate.

The unusual vehicle for the challenge is a gun rights lawsuit that was initially filed against Sessions in his former capacity as attorney general. Goldstein is asking the justices to determine who should now be the valid defendant in the case — and many other pending cases directed at the federal government’s top law enforcement official.

“This is the extraordinary case in which the identity of the successor is both contested and has important implications for the administration of justice nationally,” the motion states.

Goldstein contends that federal law requires that the Senate-confirmed deputy attorney general ― Rosenstein ― should automatically take over when the attorney general’s office is vacant. Whitaker was serving as Sessions’ chief of staff, a post that was not Senate-confirmed....
So, the argument is that since the post was automatically filled by Rosenstein :lol: the Vacancy Rule/Law never applied. Could be, we'll see.

The Senate released Monday a pair of reports that found Russia engaged in an all-out social media campaign on Donald Trump's behalf during the 2016 election and continued to support him after he took office....

The Oxford report said the Russian trolls' efforts focused on a few main objectives: pushing African-American voters to boycott the election and giving them misinformation about how to vote; getting Latino voters to distrust the U.S. government; "encouraging extreme right-wing voters to be more confrontational"; and spreading false stories and conspiracy theories....

"This newly released data demonstrates how aggressively Russia sought to divide Americans by race, religion and ideology, and how the IRA actively worked to erode trust in our democratic institutions," Senate Intelligence Committee Chairman Richard Burr, R-N.C., said in a statement Monday. "Most troublingly, it shows that these activities have not stopped."
With a tiny 77K EC margin across 3 key states, everything mattered.

They include Marco Rubio of Florida, otherwise none of the other GOP Senators from Russia NC, AL, FL, SC or TN.

I'll watch it in some form or another, but I don't expect he will say much I care about with ongoing investigations.
