Rover Pipeline Sets Record for Environmental Violations

Energy Transfer Partners' controversial $4.3 billion Rover pipeline has more negative inspection reports than any other major interstate natural gas pipeline built in the last two years, according to a new Bloomberg analysis.

The 713-mile pipeline, which will carry fracked gas across Pennsylvania, West Virginia, Ohio and Michigan and Canada, has been stalled from numerous environmental violations, including a 2 million gallon drilling fluid spill into an Ohio wetland in April.

Rover has accrued 104 violations since construction of the $4.2 billion project in started in March.

That's more negative reports than the next four pipeline projects combined, including William's Virginia Southside Expansion (26 reports), Enbridge's Algonquin Incremental Market (24), Williams' Dalton Expansion (23) and Endbridges Sabal Trail (18)....

US court halts construction of Keystone XL oil pipeline

A federal judge on Thursday halted construction of the Keystone XL oil pipeline, arguing that President Donald Trump's administration had failed to adequately explain why it had lifted a ban on the project.

The ruling by Judge Brian Morris of the US District Court for the District of Montana dealt a stinging setback to Trump and the oil industry and served up a big win for conservationists and indigenous groups.

Trump granted a permit for the $8 billion conduit meant to stretch from Canada to Texas just days after taking office last year. He said it would create jobs and spur development of infrastructure.

In doing so the administration overturned a ruling by then president Barack Obama in 2015 that denied a permit for the pipeline, largely on environmental grounds, in particular the US contribution to climate change.

The analysis of a cross-border project like this is done by the State Department.

The same environmental analysis that the department carried out before denying the permit in 2015 was ignored when the department turned around last year and approved it, the judge argued.

"An agency cannot simply disregard contrary or inconvenient factual determinations that it made in the past, any more than it can ignore inconvenient facts when it writes on a blank slate," Morris wrote.

He added: "The department instead simply discarded prior factual findings related to climate change to support its course reversal."

The judge also argued that the State Department failed to properly account for factors such as low oil prices, the cumulative impacts of greenhouse gases from the pipeline and the risk of oil spills....

One of the plaintiffs, the Sierra Club, welcomed the judge's decision.

"Today's ruling makes it clear once and for all that it's time for TransCanada to give up on their Keystone XL pipe dream," Sierra Club senior attorney Doug Hayes said in a statement.

"The Trump administration tried to force this dirty pipeline project on the American people, but they can’t ignore the threats it would pose to our clean water, our climate, and our communities."

Report: 90% of Pipeline Blasts Draw No Financial Penalties

A striking report has revealed that 90 percent of the 137 interstate pipeline fires or explosions since 2010 have drawn no financial penalties for the companies responsible.

The article from E&E News reporter Mike Soraghan underscores the federal Pipelines and Hazardous Materials Safety Administration's (PHMSA) weak authority over the fossil fuel industry for these disasters.

The government levied a mere $5.4 million in fines for the 13 pipeline explosion and fire cases in the last eight years, the analysis found.

"That's less than one day of profits for one major pipeline company, TransCanada. It's $2 million less than what [TransCanada CEO Russ Girling] made last year," Soraghan explained in a tweet.

One of the country's largest natural gas pipeline accidents—the 2010 San Bruno, California pipeline explosion that resulted in eight deaths—fell under state jurisdiction rather than PHMSA. California authorities imposed a record $1.6 billion fine against Pacific Gas and Electric (PG&E)....

Citing PHMSA data, the Washington Post reported that more than 300 people have died and 1,200 have been injured due to natural gas pipeline incidents in the last 20 years—and the nation's aging gas distribution network further increases these risks....
