13-year-old dies in Phoenix after teen pulls out real gun during Nerf gun fight

... Earlric Reynolds sustained a fatal gunshot wound while he and Adolfo Villalva, 18, were playing with Nerf guns yesterday afternoon near 7th Avenue and Hatcher Road.

... Court records show Villalva allegedly told investigators his mother keeps a gun under the seat of her car. The teenager allegedly took the gun and placed it in his pocket because it "looked cool."

Villalva indicated he was handling the Nerf toy gun and the real gun at the same time while playing around with Reynolds. While pointing both objects at the 13-year-old, Villalva said he pulled what he thought was the toy's trigger but actually pulled the firearm's trigger.

Police have taken Villalva into custody and he's facing charges of manslaughter and evidence tampering.

Texas boy, 10, confesses to fatally shooting a sleeping man when he was 7, authorities say

... After obtaining a pistol he found in the glove box of his grandfather’s truck, the child told investigators he entered Rasberry’s RV, according to the release.

Authorities said the child stated he had never met Rasberry though had seen him walking around the RV earlier that day.

The child told investigators he saw Rasberry sleeping, approached him and fired a shot, striking the man once in the head, according to the Gonzales County Sheriff’s Office....

“The child was also asked if he was mad at Brandon for some reason or if Brandon had ever done anything to him to make him mad, the child stated no,” according to the Gonzales County Sheriff’s Office’s news release....

In Texas, a child can’t be legally held responsible for a criminal act before reaching 10 years old. Because the child was 7 years old at the time of Rasberry’s death, the Gonzales County Attorney’s Office will not file or accept murder charges in the case, according to the Gonzales County Sheriff’s Office....
Makes sense, but then anyone allowing a child younger than 10 access to a gun should be legally held responsible for a criminal act. Lock grandfather up!

The technicalities of "legal" sometimes obscure reality. F'rinstance, a 17-year old may not be legally able to consent to a sexual relationship with the hot teacher, but clearly he can, of his own accord, voluntarily agree and happily so. And while I don't advocate actually charging a 7-year old with murder, I think if some serious behavioural/psychological attention isn't given to him, he'll just be a time bomb waiting to go off when he's old enough to buy/steal another and bigger gun.

That is a recourse here. I believe that at any age he can be adjudicated in need of mandatory and indefinite inpatient or intensive outpatient psych care.

Back when geezers were kids, it wasn't unusual for kids to carry around their cowboy guns or play some version of cops and robbers shooting at each other. I suppose it's possible that a kid then might not know the difference in a toy gun and a real one and accidentally shoot somebody while thinking he was playing. But in 2024 any kid that has been taught it's ok to shoot somebody in their sleep is gonna be bad news sometimes.
