Gun Legislation

Generally an unmoderated forum for discussion of pretty much any topic. The focus however, is usually politics.

Ugh.

Robert Reich @RBReich

Perhaps we shouldn't be taking public safety advice from a senator who helped incite a deadly insurrection at the U.S. Capitol.
Did you say “every time there’s a shooting”?!! Is that really how you want to start your defense of guns?!! You being so tone deaf and uttering “every time” says more about the subject matter than anything you said afterwards! @tedcruz @SenTedCruz is a national embarrassment!
"how DARE people make mass shootings about guns?!" -ted cruz
Ted Cruz spent a week outraged about Dr Seuss but shrugs off the murder of 10 innocent bystanders.

Ted Cruz will go down as one of, if not *the* most worthless, self-serving, unnecessarily partisan politicians of all time. He is truly as despicable as they come, seemingly tripping over himself to do or say the worst thing imaginable at any given turn.

I know. Ted should be in a new Dr. Seuss book in which he perpetually has his dick in his mouth after stepping on it. It could be titled "Cruz Into Cruzville" or "Daddy, Don't Kill President Kennedy and I'll Stop Beating That Sausage." It's really up in the air.

TN will soon be a veritable dream come true for gun nuts in spite of warnings by law enforcement, the business community, and religious organizations. Boy howdy. I will soon be able to buy a gun and carry it around openly or surrepitiously with no background check, no training, and plenty of beer. This will not turn out good.

Yeah, it won't be too much longer before any yahoo who can talk and breathe will be able to buy a gun and walk around anywhere with it. I think it's July 1st....just in time to be "patriotic" for the 4th. I figure to get some dynamite for the 4th myself. And maybe some hot dogs.

It wouldn't surprise me at all if it turns out the parents of this kid are the reason she did this.,,,,,the parents turned their kid into the same kind of nutjob they are. I guess the tragic part of it is that if she were home schooled this never would have happened. At least not at school. But that would have likely interfered with target practice and drinking.

I haven't looked further into it yet, but odds are that the parents at least provided access to the gun. If so, charge them.

No Bankruptcy for You! Judge Rules NRA Must Answer Corruption Charges in New York

The National Rifle Association had a clever plan to avoid the state of New York’s efforts to shut it down over allegations of executive self-enrichment: Declare bankruptcy and reincorporate in the Lone Star state. But Tuesday, after a weeks-long trial, a federal judge has called bullshit on the NRA’s Texas two-step. U.S. Bankruptcy Court judge Harlin Hale ruled that the NRA’s bankruptcy petition was “not filed in good faith” and represented, instead, an “effort to gain an unfair litigation advantage” against the state of New York and to avoid accountability in the state where the non-profit gun group has been chartered since the late 1800s.

“The question the court is faced with,” Hale wrote, “is whether the existential threat facing the NRA is the type of threat that the Bankruptcy Code is meant to protect against. The court believes it is not.” ...
This could ultimately result in huge judgements against the NRA and its execs, its dissolution and even prison for Wayne LaPierre and his cronies.

Firefighter fatally shot, captain injured by colleague at Agua Dulce fire station

Image

Los Angeles County Fire Department Chief Daryl L. Osby has dealt with the loss of many lives over the years, "but none as tragic as today," he said Tuesday.

Never before has an off-duty firefighter walked into one of his firehouses, taken aim with a gun and started shooting — until Tuesday morning at Fire Station 81 in Agua Dulce, where a gunman killed a fellow firefighter and wounded a captain before later turning the gun on himself....

After the attack, the gunman fled to his home on Bent Spur Drive in Acton — about 10 miles away — where he barricaded himself before allegedly setting the house on fire....
The only thing that can stop a bad firefighter with a gun and a Zippo is a good firefighter with a gun and a Zippo.

We'll always have ammosexuals, but we MIGHT be witnessing the death of the NRA.
That's good enough for me. I don't really mind if a guy needs to buy a big gun to make up for a tiny dick, but if the disproportionate political strength of the NRA is beat back, maybe we could finally get some reasonable legislation.
We also have to worry about ammosexual judges like your homey:
U.S. judge overturns California’s ban on assault weapons

A federal judge Friday overturned California’s three-decade-old ban on assault weapons, ruling that it violates the constitutional right to bear arms.

U.S. District Judge Roger Benitez of San Diego ruled that the state’s definition of illegal military-style rifles unlawfully deprives law-abiding Californians of weapons commonly allowed in most other states and by the U.S. Supreme Court.

“Under no level of heightened scrutiny can the law survive," Benitez said. He issued a permanent injunction against enforcement of the law but stayed it for 30 days to give state Attorney General Rob Bonta time to appeal.

Gov. Gavin Newsom condemned the decision, calling it “a direct threat to public safety and the lives of innocent Californians, period."

In his 94-page ruling, the judge spoke favorably of modern weapons, said they were overwhelmingly used for legal reasons.

“Like the Swiss Army knife, the popular AR-15 rifle is a perfect combination of home defense weapon and homeland defense equipment. Good for both home and battle," the judge said in his ruling's introduction.
Seriously? Who slays scores at a time with a Swiss Army knife?
That comparison “completely undermines the credibility of this decision and is a slap in the face to the families who’ve lost loved ones to this weapon," Newsom said in a statement. “We’re not backing down from this fight, and we’ll continue pushing for common sense gun laws that will save lives.”

Bonta called the ruling flawed and said it will be appealed.

California first restricted assault weapons in 1989, with multiple updates to the law since then.

Assault weapons as defined by the law are more dangerous than other firearms and are disproportionately used in crimes, mass shootings and against law enforcement, with more resulting casualties, the state attorney general’s office argued, and barring them “furthers the state’s important public safety interests.” ...
Huge case. The future of gun control may rest upon it. The NRA never challenged the Clinton ban on assault weapons because it was sure that it would lose.

Benitez is a Shrub appointee. Sadly, he's been backed up before:
Judicial Opinions

In 2019, Benitez granted summary judgment in a lawsuit against California's ban on "Large Capacity Magazines" (LCMs). The opinion addressed the lengthy history of firearms and self-defense rights in America, and the roots in English history. Attorney General Xavier Becerra appealed the ruling to the 9th Circuit. In 2020, a three-judge panel affirmed Benitez's grant of summary judgment in a 2-1 decision authored by Judge Kenneth Lee. The attorney general has requested an en banc rehearing of the case....
