Laws prohibiting handgun sales to people under 21 are unconstitutional, appeals court rules

In a decision that could resonate nationally in future cases, a divided three-judge panel at the Fourth US Circuit Court of Appeals on 13 July argued that the Second Amendment doesn’t “necessarily extend full force” to children under 18, but that “‘the people’ protected by the Second Amendment includes at least” people age 18 and older.

“Virtually every other constitutional right applies whatever the age,” wrote Donald Trump-appointed Judge Julius Richardson in the court’s majority opinion. “And the Second Amendment is no different.”

The opinion – joined by George W Bush-appointed Judge G Steven Agee – also noted that 18-year-olds were “required at the time” of the constitution’s writing “to serve in the militia and furnish their own weapons.”

A dissenting opinion from Judge James Wynn Jr argued that the decision should be left with lawmakers and accused the majority of granting “the gun lobby a victory in a fight it lost on Capitol Hill more than [50] years ago.”

The ruling is not “consistent with the proper role of the federal judiciary in our democratic system,” wrote Judge Wynn, who was appointed by Barack Obama.

“The Second Amendment is exceptional not because it is uniquely oppressed or imperiled, but rather because it is singularly capable of causing harm,” he wrote.

The appeals court’s decision – the latest indication of the growing right-wing dominance in the federal judiciary – sends the case back to a lower court and is likely to be appealed before it is potentially kicked up to the US Supreme Court, which has not heard a gun rights decision in more than a decade....

A Utah company has stopped selling a kit that encases Glock handguns in Lego blocks, amid uproar and after the Danish toymaker demanded it cease and desist.

Marketing the “Block19” as a “a childhood dream come to life”, Culper Precision introduced it on Instagram, saying: “We wanted the second amendment to simply be too painful to tread on, so there was only one logical solution.”

Red, yellow and blue blocks made the original weapon barely visible, disguising it as a child’s toy.

Selling the kits for $549 to $765, the company enticed adult gun users to buy the gun “made out of the Legos you got from Santa”.

At the urging of gun control activists, Lego sent the company a cease and desist letter, demanding it stop producing the Block19.

Culper Precision’s president, Brandon Scott, told the Washington Post a lawyer told him Lego might have a case if he kept offering the Block19. He decided to comply.

“They had a similar reaction to you,” he said. “Where it was like: ‘Is it wise to make a gun look like a toy?’”

According to a report from the nonprofit Everytown for Gun Safety, the period from March to December 2020 saw a 31% increase in unintentional shooting deaths by children of themselves or others, compared with the same period in 2019.

The coronavirus pandemic kept millions of children home as gun ownership reached record highs. The problem continues. Last week, a 12-year-old in California died after he accidentally shot himself with a gun his friend brought to a sleepover.

Shannon Watts of Everytown for Gun Safety, which sent a letter to Lego about the Block19, told the BBC there was a risk that children may be drawn to use firearms “even when guns don’t look like toys”.

But the company doesn’t appear to be apologetic. In a Tuesday Instagram post, Culper Precision said “our business is taking a firearm of known value” and transforming it into a “personalized invaluable treasure for a fair price”.

It added that people “have the right to customize their property to make it look like whatever they want”.

Mexico on Wednesday sued 10 U.S. gun manufacturers and distributors in U.S. federal court in Boston, arguing that the gunmakers knowingly and actively facilitate the southward flow of firearms to Mexican drug cartels. "These weapons are intimately linked to the violence that Mexico is living through today," Foreign Minister Marcelo Ebrard said at a news conference. Officers found Daniels in a neighboring apartment and applied a tourniquet to his upper leg to stop the bleeding. He told officers he had removed the magazine from the handgun before the incident took place, according to police.

Pleasant said Daniels had allowed her to “play” with the gun and she also thought it wasn’t loaded at the time, police said. But an officer who recovered the gun found it had one bullet in the chamber and six in the magazine.

“If the magazine had not been inserted into the gun when Ms. Pleasant fired the shot, there would have been no round in the chamber later when the gun was found,” police said....
Okay, Jashanti Pleasant is an idiot. However, James Daniels brought the gun, handed it to her and told her it was unloaded. Also, it was not his first rodeo:
Daniels was out on bond on nine counts of recklessly endangering safety while armed and was not allowed to possess any weapons, police said. He now faces additional charges, the Kenosha News reported.
I'd say that shooter Jashanti is an agent of karma.

Accidental gun deaths by children grew 31 percent during the COVID-19 pandemic, new data shows

Accidental deaths from gunshots among children jumped 31 percent during the start of the COVID-19 pandemic - March 2020 to December 2020 - when compared to that same timeframe in 2019, new data from Everytown reported.

The nonprofit, which advocates for gun safety, has tracked unintentional gun injuries and deaths by children since 2015. According to their #NotAnAccident index, there were 2,070 accidental shootings by children since then, resulting in 756 deaths and 1,366 injuries.

This year is expected to exceed that high number, according to Everytown. The first six months of 2021 saw the highest number of gun-related incidents involving children in the last seven years.

Gun sales surged in 2020 by 64 percent, and the number of children living in a home with at least "one loaded, unlocked gun" increased from 4.6 million in 2015 to 5.4 million in 2021, according to the nonprofit and federal data.

Of the unintentional shootings reported, seven out of 10 occurred in homes and were most frequently when children were likely to be home, like over the weekend, over the summer, or during holidays. It is notable that children have been spending much more time at home since the start of the COVID-19 pandemic in March 2020.

In the six years Everytown has been tracking these incidents, teenagers aged 14-17 made up the largest age group of children involved in unintentional shootings, but the second-largest age group was children aged five and younger. "In 2020 alone, at least 125 toddlers and pre-kindergarteners ages five and under shot themself or someone else," according to Everytown.

"Shootings by children are most often the shootings of children," according to Everytown. "Ninety-one percent of those injured or killed in unintentional shootings by children were also under 18."

... According to Everytown, "rates of death or injury from these shootings in states with no secure storage laws were double to triple the rates in states with laws that hold gun owners accountable when children can or do access an unsecured gun."
When children are given access to guns I might quibble over the definition of "Accidental".
