Senate Judiciary Committee Chair Dick Durbin (D-Ill.), who spoke on the floor after McConnell, countered by reminding colleagues of McConnell’s decision to block then-Judge Merrick Garland, whom Obama had nominated to serve on the Supreme Court in 2016, from even getting a hearing while Republicans controlled the Senate.

“When I hear the senator [McConnell] come to the floor … and talk about whether there is any gamesmanship going on, I don’t know. But I can tell you we saw it at the highest possible level in filling the vacancy on the Supreme Court when Antonin Scalia passed away,” Durbin retorted.

Senate Republicans kept Scalia’s seat vacant for nearly a year, which gave Trump the opportunity to nominate conservative Judge Neil Gorsuch to fill it in 2017.

A Democratic aide pointed out that at least three Republican-appointed judges rescinded their decisions to retire over the past 16 years.

Judge Rudolph Randa of the Wisconsin Eastern District rescinded his senior status letter in 2008 after Obama won that year’s election.

Judge Michael Kanne of the 7th Circuit Court of Appeals rescinded his senior status letter in 2018 after Trump didn’t pick his preferred successor.

And Judge Karen Caldwell of the Kentucky Eastern District rescinded her senior status in 2023 after her failed attempt to pick her successor.

It wouldn't be hypocritical if he'd just admit it's politics as usual. But for him to stand there and say his job is to keep Obama from appointing a Justice, and then to act like the judges rescinding their retirements is "unprecedented" and a prime reason for all of the climate change that isn't happening is just ridiculous.

Depends on KY law. Even then, Gov Andy Beshear (D) has walked a middle path. He might be inclined to appoint a moderate, independent Repub if one can be found.

Is Beshear term limited? If so, he will go with a democrat to keep alive any future hopes alive as a democrat.
