Biden extends time in US for 800,000 Venezuelans, Salvadorans as Trump readies immigration crackdown

About 600,000 Venezuelans and more than 230,000 Salvadorans already living in the United States can legally remain another 18 months, the Department of Homeland Security said Friday, barely a week before President-elect Donald Trump takes office with promises of hardline immigration policies.

Biden’s administration has strongly supported Temporary Protected Status, which he has broadly expanded to cover about 1 million people. TPS faces an uncertain future under Trump, who tried to sharply curtail its use during his first term as president. Federal regulations would allow the extensions to be terminated early, although that’s never been done before.

Homeland Security also extended TPS for more than 103,000 Ukrainians and 1,900 Sudanese that are already living in the U.S.

... About 1 million immigrants from 17 countries are protected by TPS, including people from Venezuela, Haiti, Honduras, Nicaragua, Afghanistan, Sudan, Ukraine and Lebanon. Venezuelans are one of the largest beneficiaries and their extension runs from April 2025 to Oct. 2, 2026.

Trump and his running mate, JD Vance, suggested they would scale back the use of TPS and policies granting temporary status as they pursue mass deportations. During his first administration, Trump ended TPS for El Salvador but was held up in court....

Localities are till free to do as they please. It is their choice if they desire to continue receiving federal funds.

The example Vrede uses is off subject. Funds are being withheld because the localities are not assisting with enforcing law.

Logic much? There's nothing magical about "assisting with enforcing law." It's something you bigots want but aren't willing to pay for, and locales are exercising their freedom to not volunteer. What if it was federal environmental law? Just grow a pair and admit that you are necessarily endorsing Dems being similar bullies when they are in power and red locales don't volunteer to do blue stuff. We can all see it.

Btw, local PDs that think preventing and solving murder, rape, child abuse, etc is important have very good reason to not have a whole community afraid of immigration enforcement when they cooperate. It's sad that DonOLD and your bigotry is so pathological that you don't care about these far more serious crimes than crossing the border for work.

AG Bondi (who I know is a real lawyer or at least was or wanted to be sometime in the past) might want to review some prior decisions. Another example of willful violation, so-sue-me approach and attempt to intimidate.
Federal actions intended to force local jurisdictions to perform immigration enforcement are likely unconstitutional. Under the Tenth Amendment of the U.S. Constitution, the Federal government “may neither issue directives requiring the States to address particular problems, nor command the States’ officers, or those of their political subdivisions, to administer or enforce a federal regulatory program.” The Supreme Court has clarified that immigration enforcement is the sole duty of the federal government, and state and local police may only carry out immigration enforcement if specifically authorized to do so by the federal government.

Compliance with immigration detainers is voluntary, not mandatory. The federal government cannot force local jurisdictions to honor detainers, an interpretation repeatedly upheld by the courts. Some state courts have also ruled that the laws of their state do not provide legal authority for law enforcement agencies to hold people on an immigration detainer. In fact, jurisdictions that do honor detainers can be found liable for unlawfully holding an individual on a detainer without a judicial warrant in violation of the Fourth Amendment, and may be required to compensate individuals for damages.
