I wondered the same thing. The pessimistic view is that they figure Chevron will eventually curtail OSHA once it works its way through the lower courts. Thus, taking the case would be redundant.

House Democrat is proposing a constitutional amendment to reverse Supreme Court's immunity decision

A leading House Democrat is preparing a constitutional amendment in response to the Supreme Court's landmark immunity ruling, seeking to reverse the decision “and ensure that no president is above the law.”

Rep. Joseph Morelle of New York, the top Democrat on the House Administration Committee, sent a letter to colleagues informing them of his intent to file the resolution, which would kickstart what's traditionally a cumbersome amendment process.

"This amendment will do what SCOTUS failed to do — prioritize our democracy,” Morelle said in a statement to AP....

“This amendment will guarantee that no public officer of the United States — including the president — is able to evade the accountability that any other American would face for violating our laws,” Morelle wrote in a letter to colleagues this week.

He quoted from Justice Sonia Sotomayor, who led the dissent, and Justice Ketanji Brown Jackson who joined in dissenting, before summing up his in his own words: "Presidents are citizens, not tyrants."...

Can co-conspirators still be prosecuted? For example, if TRE45QN can't be held accountable for the fake electors scam, what about the fake electors and the lawyers that organized them? Is there blanket immunity if POTUS was engaged in an "official act"?

Rational answer: No, because the fact that Trump can't be prosecuted doesn't make it lawful. Further, while many if not most of those involved in fake electors thought they were following Trump, none of them had any legitimate obligation to act unlawfully just because they thought Trump said so.

Real Life answer: who knows? The country as we used to know it is doomed anyway.

It could also create a line of defense against a president pushing the boundaries of legality.

“Usually, the president and the staff are aligned in not wanting to commit crimes,” said Neil Eggleston, a veteran attorney who served as White House counsel in the Obama administration. “But if you have a corrupt president and you are staff, you have to think to yourself, ‘Am I going to get dragged into something the president won’t be prosecuted for, but I can be?’”

"We do not make this request lightly": Senators demand criminal investigation into Clarence Thomas

U.S. Senators Sheldon Whitehouse, D-R.I., and Ron Wyden, D-Ore., are requesting a criminal investigation into Supreme Court Justice Clarence Thomas for potentially violating federal ethics and tax laws.

In a letter written to Attorney General Merrick Garland last week, Whitehouse and Wyden requested the appointment of a Special Counsel to determine whether Thomas violated several laws in his failure to disclose a forgiven loan and gifts he received from benefactors.

Thomas failed to disclose a forgiven loan of $267, 230.00 as income after he failed to repay said loan, which he used to purchase a luxury motorcoach.

It raises questions of whether Thomas “properly reported the associated income on his tax return,” a statement from Whitehouse reads.

“We do not make this request lightly. The evidence assembled thus far plainly suggests that Justice Thomas has committed numerous willful violations of federal ethics and false-statement laws and raises significant questions about whether he and his wealthy benefactors have complied with their federal tax obligations,” the Senators wrote in the letter.

The senators also requested that the Department of Justice name a special counsel to investigate the undisclosed gifts Thomas received from “billionaire benefactors,” including private jet travel, a country club membership, home renovations and tuition for his son. According to an investigation by ProPublica, Thomas has been treated to vacations by billionaire Republican donor Harlan Crow for over 20 years....
