Chris Hayes: Amid national GOP's anti-trans crusade, some in Montana's GOP show all hope is not lost

Right now, Republicans are waging a campaign of persecution against transgender people at every policy level across this country. On Capitol Hill, House Republicans are openly attacking the first openly trans member of Congress, Democratic Rep. Sarah McBride of Delaware....

Lest you be left hopeless by that genuinely enraging exchange, we saw something close to the polar opposite unfold in the Montana House of Representatives last Thursday. Republicans hold a near two-thirds majority in that chamber. Last week, they considered two anti-LGBTQ bills. The first was a bill that would allow people to sue drag performers. The second was a draconian bill which sought to remove trans kids from their parents. But Democrats were not going down without a fight.

Montana has two trans or nonbinary Democrats elected to the state Legislature, both of whom delivered earnest, heartfelt speeches about why these bills should not become law....

Following those speeches, 13 Republicans flipped their votes against the drag ban. It was defeated 55 to 44....

That same day, Rep. SJ Howell, who is nonbinary, delivered a speech of their own on the bill that would allow Child Protective Services to remove trans children from homes that affirm their identities. “Put yourself in the shoes of a CPS worker who is confronted with a young person, 15 years old maybe, who is happy, healthy, living in a stable home with loving parents, who is supported and has their needs met,” Howell said. “And they are supposed to remove that child from their home and put them in the care of the state? We should absolutely not be doing this.”

Following Howell's speech, 29 Republicans flipped their votes. The bill was defeated overwhelmingly, 71 to 27.

It is really easy these days to lose hope in the basic mechanics of democracy. But what happened in Montana last week was an incredible shining example that shows it’s not all for naught. People can be persuaded away from cruelty and viciousness and there is some hope on the other side.

But it is weird that right wing nugjobs obsess over drag shows and trans people. Before that it was critical race theory and i think before that it was green M&M's or something. 'Unfair exclusionary policy': 2nd judge blocks Trump's transgender military ban in scathing ruling

If allowed to go into effect, the Trump administration's new policy on transgender soldiers would be a "de facto blanket prohibition" that seeks "to eradicate transgender service," a federal judge wrote Thursday in issuing a preliminary injunction against the policy.

In a 65-page opinion issued late Thursday, U.S. District Judge Benjamin Settle became the second federal judge to block the policy, which he described as discriminatory and disconnected from the goals of "military readiness, unit cohesion, lethality, or any of the other touchstone phrases long used to exclude various groups from service."

... "The government's arguments are not persuasive, and it is not an especially close question on this record," he wrote, finding that each of the plaintiffs would be irreparably harmed by the policy, which would curtail their military service.

Judge Settle also called out the Trump administration for seemingly disregarding the service history of the transgender soldiers who brought the case, such as the Commander Emily Shilling, a naval aviator with 19 years of service who flew 60 combat missions before becoming a Navy test pilot.

"There is no claim and no evidence that she is now, or ever was, a detriment to her unit's cohesion, or to the military's lethality or readiness, or that she is mentally or physically unable to continue her service," Settle wrote.

"There is no claim and no evidence that Shilling herself is dishonest or selfish, or that she lacks humility or integrity. Yet absent an injunction, she will be promptly discharged solely because she is transgender," wrote the judge.

A judge offered a scathing rebuke of the Pentagon's development of the policy.


President Donald Trump's attempt to ban transgender people from military service continues an unfortunate history of the armed services excluding marginalized people from the "privilege of serving," a federal judge wrote Tuesday night.

In a 79-page decision, U.S. District Judge Ana Reyes blocked the Trump administration from enacting the policy and offered a scathing rebuke of the Pentagon's development of the policy.

"The Court's opinion is long, but its premise is simple. In the self-evident truth that all people are created equal, all means all. Nothing more. And certainly nothing less," Judge Reyes wrote.

The ruling came as part of Talbott vs. Trump, a lawsuit filed on Jan. 28 in the U.S. District Court for the District of Columbia by LGBTQ+ advocacy groups Glad Law and the National Center for Lesbian Rights on behalf of six active duty transgender service members.

During a press conference on Wednesday morning following the judge's ruling, 2nd Lt. Nicholas Talbott and Maj. Erica Vandal, both plaintiffs in the lawsuit, expressed relief and said they look forward to continuing to serve their country.

"[This preliminary injunction] has provided immense relief for myself and my family, personally, along with the numerous others impacted," Vandal said. "It's a massive burden lifted knowing that I can continue to provide for my wife and two children, while continuing my career and lifelong passion as a field artillery officer."

Lt. Talbott, a platoon leader in the U.S. Army Reserve, said that the ruling is a "tremendous step forward" and a "breath of fresh air."

"Transgender service members are just as qualified, competent and dedicated as any other military member, and we are thrilled to be able to continue to put on our uniforms and perform the jobs we have worked so hard for in service of our country," Talbott said.

Talbott said he is “confident” that the court will “continue to find that transgender people have no negative bearing on the United States military.”

In an interview later with ABC News Live, Talbott said, "For me, it has been like a huge weight is suddenly lifted off my shoulders. Now I can get back to focusing solely on the mission at hand … and continuing to serve my country."

... According to Reyes, the Trump administration failed to justify the policy by articulating its impact on military readiness, harmed thousands of transgender service members, and likely violated the United States Constitution.

"The President has the power—indeed the obligation—to ensure military readiness. At times, however, leaders have used concern for military readiness to deny marginalized persons the privilege of serving," Reyes wrote.

"[Fill in the blank] is not fully capable and will hinder combat effectiveness; [fill in the blank] will disrupt unit cohesion and so diminish military effectiveness; allowing [fill in the blank] to serve will undermine training, make it impossible to recruit successfully, and disrupt military order," she added. "First minorities, then women in combat, then gays filled in that blank. Today, however, our military is stronger and our Nation is safer for the millions of such blanks (and all other persons) who serve."

While the judge acknowledged that the judiciary should generally defer to military leadership, she said that permitting the policy to be enforced would be her following the Pentagon "blindly" after it justified the policy with "pure conjecture" during multiple court hearings.
