Introducing Legislation to Keep Families Together



This week, I introduced the Keep Families Together and Enforce the Law Act. Migrant children should not be separated from their families, and this legislation provides the solution by clarifying federal law to ensure that families will remain together and receive good care as they go through the legal process. In addition, the Keep Families Together and Enforce the Law Act requires the Department of Homeland Security to take steps to reunify families that were previously separated.

I share your concerns and introduced H.R. 6134, the Equal Protection of Unaccompanied Minors Act – a bill to reunite families and end the practice of separating children from their parents. I do not support the separation of families while the parents go through the legal process of asylum entrance into the United States. I have children myself, and I cannot imagine the pain and fear that many of these families have experienced.

My bill, H.R. 6134, the Equal Protection of Unaccompanied Minors Act, would end this practice of separating minors from their parents after they have been apprehended at the border. This bill will fix the root cause of the problem--by closing some of the loopholes in our asylum laws, preventing criminals from using kids to take advantage of the rules. This legislation would make it so that families who have already been separated from their children would legally be able to be reunited. A prevailing concern throughout this process is to monitor for adults bringing children across the border who are a danger to children, or who are falsely claiming to be the parent of a child for preferential entry into the United States. In these cases, it is the obligation of the United States to keep children as safe as possible and place them with their true parent, a relative, or safe foster home.

On June 20, 2018, President Trump signed an Executive Order which directs the Department of Homeland Security to keep families together while their asylum status is pending. President Trump's Executive Order directs Attorney General Jeff Sessions to “file a request with the U.S. District Court for the Central District of California to modify the “Flores settlement" in a manner that would permit the Secretary [of Homeland Security], under present resource constraints, to detain alien families together throughout the pendency of criminal proceedings for improper entry or any removal or other immigration proceedings.” The Flores Settlement Agreement is a case from 1997 that required the federal government to release undocumented immigrant children, first to their parents if possible, to other adult relatives if not, and to licensed programs willing to accept custody if no relatives are available.
