The chain of command for a National Guardsman who pleaded guilty to being a part of the mob that ransacked the U.S. Capitol on Jan. 6 is closing ranks and begging the Army to allow him to continue serving.

Pfc. Abram Markofski is set to be sentenced Friday. He faces up to six months in prison and has already agreed to pay a $500 fine for his role in the riot, which did an estimated $1.4 million in damage to the Capitol.

The mob, which Markofski has admitted to joining, stormed the Capitol in an attempt to stop the peaceful transition of power, one of the most perilous moments for democracy in the history of the country that the soldier had sworn an oath to defend....

Chris Christie Says Capitol Riot 'Driven From the Top' as Feud With Trump Intensifies

"All the things that you see were driven from the top," Christie said during an appearance on ABC's This Week, in response to host George Stephanopoulos' comment about the events that led up to the Capitol riot, including the role of those loyal to Trump in the White House during his presidency.

"It may explain why the former president and his allies are working so hard not to cooperate," said Stephanopoulos.

Christie responded: "The [former] president made it very clear that he did not want to concede the election, that he would not concede the election, and you got a bunch of people around him by the time we got to the end, with very few exceptions, that were C-team players, at best, on their best day."

Those C-team players, Christie said, would tell the former president what he wanted to hear despite people "on the outside" telling him that "this is over and you need to concede."

"He didn't want to hear that. So he went to the C-team players and got that," Christie added.

The former Republican governor said that the January 6 committee's investigation will eventually reveal the facts relevant to the Capitol attack, but he added, "Let's not kid ourselves. This was a driven-from-the-top process executed by C-team players. And that's why it looks like a Keystone Cops operation, because it was." ...

Judge refuses to toss key charge in Capitol riot case

A federal judge has refused to throw out a key charge against two men accused of storming the U.S. Capitol to obstruct the Electoral College vote certification proceedings, upholding prosecutors' use of a criminal statute that many other riot defendants are charged with violating.

U.S. District Judge Dabney Friedrich ruled on Friday that an obstruction charge applies to the Justice Department's case against Ronald Sandlin and Nathaniel DeGrave. Defense lawyers have asked other judges presiding over Capitol riot cases to dismiss the same charge on related grounds.

An indictment charges Sandlin and DeGrave with obstruction of an official proceeding on Jan. 6, when a joint session of Congress convened at the Capitol to certify President Joe Biden's electoral victory. The indictment alleges Sandlin and DeGrave broke the law by stopping or attempting to stop the proceeding from going forward by engaging in disruptive conduct, including assaulting law enforcement officers.

In asking Friedrich to dismiss the obstruction count, attorneys for Sandlin and DeGrave argued that Congress’ certification of the electoral results did not constitute an “official proceeding” and that the men did not “obstruct, influence and impede” the proceeding.

... The obstruction charge is a felony punishable by a maximum of 20 years imprisonment. Jacob Chansley and Paul Allard Hodgkins, two rioters who pleaded guilty to the same obstruction charge, were sentenced to 41 months and 8 months in prison, respectively....

Before reading all of the article and despite the anti-Trumpette ruling I guessed correctly that U.S. District Judge Dabney Friedrich is a 45SHOLE appointee . It's a pretty White name. However, I got the judge's gender wrong :

Patricia Dabney Langhorne was born on June 19, 1967, in Pensacola, Florida....

She has ruled in favor of Special Counsel Robert Mueller and against Russian-owned Concord Management and Consulting, which has been indicted for financially supporting interference with the 2016 United States presidential election. Damn, a second anti-Trumpette ruling.

One of the five Polk County (Florida) residents charged with participating in the U.S. Capitol riot faces the prospect of being jailed until his trial after FBI agents found a rifle in his home.

Federal prosecutors are seeking to revoke bond for Joshua Doolin of Polk City. Doolin, 23, was indicted in June on two misdemeanor charges related to the Jan. 6 riot, and the conditions of his release prohibit him from having any weapons.

Doolin faced a status hearing Dec. 6 before U.S. District Judge Carl Nichols of the District of Columbia. Nichols deferred a ruling on the prosecution’s request to revoke Doolin’s bond.

The matter now goes to the Justice Department, which will decide whether to pursue the contempt referral. But even if Meadows is indicted, the Jan. 6 commission will essentially be at the same place as it was before: without answers on why the former president did not urge his supporters to stand down earlier.

Probation is not tough. Can you imagine the sentences if the rioters were black?
