Firing an employee is the most dangerous thing an employer can do. Not that they shouldn't fire people, but it's incredible how awful some are at it. This former teacher may not show up with the gun, but it's already not ending well, and is likely to get worse, whether bad publicity, lawsuits, violence, whatever. Really good chance it could have been avoided with better management of the exit.

My update didn't go deeper than the pnj headlines, it seems that I reached my limit of free articles 6 or 8 months ago. Gannett gets nothing from me, other than a paper that, before Gannett, didn't suck.

If George W. Bush did not suspect someone, he would say he dissuspected them. And that would be the end of it.

Pensacola Beach Elementary denies enrollment for ex-teacher's kids, despite judge's ruling
Pensacola Beach Elementary School is denying enrollment to two students based on perceived threats of gun violence made by their mother, an ex-teacher at the school, potentially igniting a legal battle over how and when a publicly funded Florida charter school can deny students admission.
At a court hearing Monday — which was set to be the first day of classes before it was pushed back one day to accommodate the hearing — Escambia County Circuit Judge Gary Bergosh denied the school's motion for a stay, which would have put his previous ruling on hold. His initial ruling, handed down July 18, ordered the school to allow Kelli Moyer's two children to enroll and Moyer to attend on-campus events, provided she sell her gun.
The judge's ruling states Moyer can apply to enroll her kids at the school and that her kids should be treated like those of any other citizen applying to attend a charter school in Florida. The ruling also states that Moyer be allowed on campus like any other parent. But in a letter sent to Moyer on Monday after the ruling, the school board made it clear they would deny her children's enrollment, citing concerns over school safety.
"If your daughters were permitted to enroll at PBES, you would be eligible to exercise the same level of extensive parental involvement that is enjoyed by the parents of each PBES student," reads the letter, provided to the News Journal by Moyer's attorney Michael Burtt. "It is the Board's belief that allowing you to become involved with PBES in this capacity would have a detrimental effect on the nurturing and safe environment that PBES strives to provide for each of its students. This belief is based on the history of your involvement with PBES as an employee, as well as the actions you have taken since your employment with PBES ended."
Bad blood between Moyer and PBES first began in 2012, when Principal Jeff Castleberry declined to renew Moyer's contract as a first-grade teacher at the school, a position she had held since 2009. In 2013, Moyer sued the school, claiming pregnancy discrimination. Moyer and the school settled in 2014 for an undisclosed amount.
In May 2019, Moyer returned to PBES for the first time since the lawsuit to try to enroll her two daughters in the first and fourth grades. That's when, according to court filings, PBES filed an injunction seeking to ban Moyer from campus. School administrators cited Facebook posts dating back to April 2018 that they claimed showed Moyer wanted to harm school staff members, including one post where she referenced a sign that bore the same name as the principal and implied she wanted to shoot it.
Burtt argued that his client's post was "ill-advised" but was blown out of proportion and Moyer posed no threat to the school. Her children are zoned for A.K. Suter Elementary School, a public school in Pensacola, but Burtt said Moyer is homeschooling her children until she's allowed to enroll them at PBES.
"She's basically disgusted with the whole thing," Burtt said. "Obviously, we believe that school safety is of paramount importance, there's no question or argument otherwise. But she doesn't pose a threat and this has all been blown out of proportion."
The attorney for PBES, Jerry Sanders, could not be reached for comment Tuesday. School Board President Ted McCurdy did not return a phone call seeking comment.
In an interview with the News Journal last week, Sanders argued that given the atmosphere of gun violence and school shootings in the U.S., Moyer's posts should be perceived as threats and she should not be allowed on campus.
Does PBES have the right to deny enrollment?
The parties involved had hoped Monday's ruling would clarify whether or not the charter school is within its right to deny a student admission based on the grounds of a perceived safety threat made by a parent. But if anything, the ruling made it even muddier.
Pensacola Beach Elementary School is a charter school, meaning it's funded with Escambia County School District tax dollars but has its own board of directors separate from the district's school board. The charter school operates as a nonprofit organization and has a contract with the district to provide educational services.
Per its enrollment policy, the school gives priority to "on-island" students, or students who live on Pensacola Beach permanently. The Moyers are full-time beach residents. Students who live "off-island," or not on Pensacola Beach, can apply to the school and are given priority based on various factors, including whether or not their parents work at the school, their parents own a business on the beach or they have siblings at the school.
If the enrollment cap is not reached for a given school year, the school has a lottery system that allows off-island residents a shot at enrolling in the school.
The policy manual doesn't explicitly state under what conditions the school board can deny a student's enrollment application or who has the discretion to make such decisions.
In Bergosh's ruling Monday, the judge ordered that Moyer "be treated like any other citizen. Therefore, (Moyer) is allowed to enroll her minor children in school at Pensacola Beach Elementary School, if they are so qualified for admission to the school based upon, inter alia, school attendance zones."
But the school board wrote in its letter to Moyer that they were denying her children's enrollment because of what they called Moyer's "continuing pattern of physical threats and intimidation towards PBES staff, which has escalated considering your apparent intention to return to PBES by enrolling your daughters as students."
Burtt said the judge denied his motion to hold the school in contempt of court, based on their decision to not allow Moyer's children to enroll. Burtt has filed a complaint asking Bergosh to force PBES to allow Moyer to enroll her children.
PBES has filed an appeal of Bergosh's decision with the First District Court of Appeals in Tallahassee.
Escambia County School District Superintendent Malcolm Thomas said the PBES school board makes its own decisions regarding school enrollment, but if the school was found to be defying a judge's order to allow the children to enroll in the school, the school district would likely intervene.
"Ignoring the direction of the court is never a good idea, but I have to see more information," Thomas said, adding that he wasn't completely aware of all aspects of the case since the Escambia County School Board is not a party to it. "If a judge has said the children meet the criteria and they should go to school, then yes, I think we would have to step in."

I'll sometimes turn off ad blocking for specific pages for some good sites. What I've found is that you access the page and the "turn off your ad blocker" box comes on. At that point, AdBlock has already cleared the ads, so when I click "don't run on this page" I still get a clean read. Occasionally a stray ad will appear after that, but not usually.

Yeah, they're hidden, but when the "turn off ad blocker" box goes away the page doesn't usually re-load, leaving you with the cleanish page. Whack9 or Banni could probably explain why - I don't know, only that it mostly always works.Vrede too wrote: ↑Wed Aug 14, 2019 10:31 pmGood to know, thanks.
