Oregon set to decriminalise heroin and LSD as Joe Biden eyes opportunity of federal cannabis legislation

... As of Monday, the possession of small amounts of heroin, cocaine, meth and other controlled drugs for personal use will cease to be a crime in Oregon. Instead it will be a civil offence, punishable by a $100 (£73) fine that can be waived by taking a health assessment.

Those cited will be referred to "addiction recovery centres", funded from the new tax revenue that is generated by legal weed businesses such as Mr Horton's. The system is loosely based on Portugal's decriminalisation in 2001, which has been praised by many abroad.

Separately, 'magic mushrooms', whose psychedelic effects have been used for centuries by native Americans, are set to be legalised for medicine and therapy in two years' time.

These measures, backed by 58pc and 56pc of Oregon voters in referendums last November, make Oregon's drug laws the most radical in the USA, and could augur yet more change for an America already softening marijuana prohibitions at rapid pace.

With the Democratic Party in control of three branches of government, advocates hope for an end to the "war on drugs" first declared by President Richard Nixon in 1971, which they believe has become an Iraq-style quagmire....

he question now is whether other states will follow. November saw votes to legalise cannabis not only in liberal New Jersey but traditionally red Arizona, Montana and South Dakota, plus medical use in Mississippi.

Five states have now legalised marijuana, with 36 others approving medical use. Shane Schmitt, general manager at the cannabis growing firm Wy'East Oregon Gardens, sees change from an unexpected source: baby boomers are a growing pot-buying demographic, and prefer trustworthy, mellow highs with labelled ingredients.

Mr Johnson believes further decriminalisation will be the next step.

"These are our first big sledgehammer hits against the overall drug war in the United States," he says. "Oregon was the first state to decriminalise cannabis, the first to pass a vote by mail measure, the first to pass a death in dignity act. Each time we've seen other states follow suit because they see success on the ground."

He predicts blue states such as Colorado and California will follow in the next four years, with federal decriminalisation of all drugs within ten or twenty....

In the long run, liberal drug laws could also help reverse the mass incarceration and military-style policing that exploded last summer in the George Floyd protests.

The threat of tooled-up drug gangs justified the mushrooming of warlike SWAT teams and mass transfers of equipment from the armed forces. Back then, one of the drug war's biggest allies in Congress was one Joe Biden, and Vice President Kamala Harris made "tough on crime" a centre of her early career.

These days both have changed their tune, promising to decriminalise cannabis at the federal level and leave the rest to states. Democrats in the House of Representatives have voted for the same, and might have more success now their colleagues narrowly control the Senate.

Mr Biden's nominee for health secretary is Xavier Becarra, the former attorney general of California who oversaw its first legal pot sales, while his pick for commerce secretary, Rhode Island governor Gina Raimondo, included plans for state-run weed shops in her 2021 budget.

Ironically, Roy Moore believes that Mr Biden's past support for the drug war actually makes him more likely to reject it now, because of how it forced him to confront Democrats' anger.

"He had to address that, he had to denounce that, and then make promises to not be that," says Mr Moore. "His base lies in the group of people who are expecting change. He has enough people around him to hold him accountable."

From the Friday pre-weekend feature in the Spokane newspaper, not in the most progressive part of the PNW, comes a bunch of weed articles. Weed for Valentines, cooking with weed, how to select, pot etiquette, older adults taking it up...yada. Meanwhile, Oregon has de-criminalized all drugs. You guys need to move.

South Dakota judge rejects amendment legalizing marijuana

A South Dakota judge on Monday struck down a voter-approved constitutional amendment that legalized recreational marijuana after Gov. Kristi Noem's administration challenged it.

Circuit Judge Christina Klinger ruled the measure approved by voters in November violated the state's requirement that constitutional amendments deal with just one subject and would have created broad changes to state government.

“Amendment A is a revision as it has far-reaching effects on the basic nature of South Dakota’s governmental system,” she wrote in her ruling.

Brendan Johnson, who sponsored the amendment and represented a pro-marijuana group in court, said it was preparing an appeal to South Dakota's Supreme Court.

Two law enforcement officers, Highway Patrol Superintendent Col. Rick Miller and Pennington County Sheriff Kevin Thom, sued to block legalization by challenging its constitutionality. Miller was effectively acting on behalf of South Dakota Gov. Kristi Noem, who had opposed the effort to legalize pot.

Klinger was appointed as a circuit court judge by Noem in 2019.

“Today's decision protects and safeguards our constitution,” Noem said in a statement. “I'm confident that South Dakota Supreme Court, if asked to weigh in as well, will come to the same conclusion.” ...

I haven't read the details, but if the sponsors of the referendum really did draw it up with defects, they need to fire some lawyers. I'm guessing this ruling will be overturned.

Depends on the makeup of the SD Supreme Court, which I imagine is con.

Or the fed supremes. If memory serves, that's who finally effectively overturned the Florida Constitutional Amendment to restore voting rights to felons that was passed by over 65% of the voters.

Jeb just ignored our Constitutional Amendment limiting class sizes in elementary schools.

According to one Repug judge. Since when is that your guidepost? Without researching the issue further I disagree that legalizing marijuana is more than "just one subject". It's not like the initiative also, say, raised the SD minimum wage.

Well, I did say I thought the one RepuQ judge would be overturned. But maybe not. The wording on the ballot did apparently include references to medical marijuana (already approved) and hemp. Whether the wording constitutes multiple subjects or not, I don't know. But I do know that a lot of lawyers have gotten fired for doing a lot less than making a technical error in the wording of a referendum.

It made me consider how right wing nutjobs have been howling about "activist judges" for years, as well as being advocates for populism. but apparently only oppose that sort of thing when the decision of the voters is something they don't like. That has not stopped Lukas Gilkey, chief executive of Hometown Hero CBD, based in Austin. His company sells joints, blunts, gummy bears, vaping devices and tinctures that offer a recreational high. In fact, business is booming online as well, where he sells to many people in other states with strict marijuana laws.

But Gilkey said that he is no outlaw and that he is not selling marijuana, just a close relation. He is offering products with a chemical compound — Delta-8-THC — extracted from hemp. It is only slightly chemically different from Delta 9, which is the main psychoactive ingredient in marijuana.

And that small distinction, it turns out, may make a big difference in the eyes of the law. Under federal law, psychoactive Delta 9 is explicitly outlawed. But Delta-8-THC from hemp is not, a loophole that some entrepreneurs say allows them to sell it in many states where hemp possession is legal. The number of customers “coming into Delta 8 is staggering,” Gilkey said.

“You have a drug that essentially gets you high but is fully legal,” he added. “The whole thing is comical.” ...

Yeah, I spotted the VA pot vote as a blurb on the front of the local newspaper. I'm not gonna get too excited because VA has no shortage of wingnuts, nutjobs, and trumpaloons in its legislature. They even have one woman who won't wear a mask so she's enclosed in a plexiglass cube on the House floor. So I figure there's more than an even chance the nutjobs will return to power in 22 and put the brakes on this evil pot scheme.

Could be, but I hope that VA continues its move to blue. That said, the delay is a shame. A lot can happen, and many people can get busted in that time even if the law stands.

While it’s traditionally been thought that using marijuana decreases sperm count, a recent study at Harvard saw the opposite results: men who partake actually had meaningfully higher sperm concentrations on average than those who don’t.

It’s important to note that the science regarding weed is pretty sparse, thanks to government prohibition around the world over the past century. As the Harvard study noted, most past studies on the topic involved animals rather than people, or men who have broad issues with substance abuse that make it impossible to pinpoint as a cause for lower sperm counts.
So, stoners will keep breeding, but getting your dog high may get him to stop humping your leg.
It’s also important to note that Fox News argued in court last year that “Tucker Carlson Tonight” is not a credible source of news or “actual facts.”

:lol: I'd been a regular pot smoker for more than fifteen years when my daughter was born. Anyway, I'm glad Tucker doesn't use pot; that just means more for me. Besides, Tucker is a fine example for why people should not sniff glue or other petrochemical solvents. It turns the brain to mush. You go, Tucker.

Right now it looks like it's illegal in only a handful of states.

I could see this helping ease things into legal weed, maybe.

If it becomes more popular and prevalent (I've seen vending machines in breweries), it could help. Or the it'll just be made illegal.
