Anyone have an opinion about the vaccine EO by DeSantis

Generally an unmoderated forum for discussion of pretty much any topic. The focus however, is usually politics.

Norwegian Cruise Line and a federal court have an opinion about the vaccine law passed by the Leg and signed by DeSantis:
Judge: Norwegian cruises can require proof of vaccination

A federal judge on Sunday night granted Norwegian Cruise Line’s request to temporarily block a Florida law banning cruise companies from asking passengers for proof of coronavirus vaccination before they board a ship.

U.S. District Judge Kathleen Williams granted the preliminary injunction in a lawsuit challenging the state’s “vaccine passport” ban, which was signed into law in May by Republican Gov. Ron DeSantis.

In a nearly 60-page ruling, the judge said Florida failed to “provide a valid evidentiary, factual, or legal predicate” for banning vaccination proof. Williams also said the cruise line company “has demonstrated that public health will be jeopardized if it is required to suspend its vaccination requirement.”

Norwegian also contends that the law is an unconstitutional infringement on the First Amendment’s free speech guarantee. The lawsuit names state Surgeon General Scott Rivkees, who leads the Florida Department of Health. The state’s attorney, Pete Patterson, previously said the law’s aim is to prevent discrimination against passengers who don’t get vaccinated.

A Norwegian cruise is set to depart from Miami on Aug. 15 — the company’s first voyage from Florida since the pandemic halted its operations.

“We welcome today’s ruling that allows us to sail with 100% fully vaccinated guests and crew which we believe is the safest and most prudent way to resume cruise operations amid this global pandemic,” Frank Del Rio, president and CEO of Norwegian Cruise Line, said in a statement Sunday.

Hilarious. GQPers incessantly squawk and whine about "government overreach" but GQP governors seem to specialize in it.

Um, the article is dated yesterday, 8-8-21. One day old. I doubt even DeSantis could harsh on sensible public health measures that fast. But you never know.

Well, as Vrede points out, the situation is complicated by multiple cases and different judgements.

From your link:
Regarding the underlying litigation, thus far the 11th Circuit hasn’t explained its reasoning for the reversal — it hasn’t published an opinion, although its order references a Supreme Court ruling governing stays in immigration cases, not public health, Nova Southeastern’s Jarvis noted.

As it stands, he said, any damage from an infectious disease point of view would be limited to the territory within the 11th Circuit, meaning Alabama, Florida, and Georgia, because the Supreme Court hasn’t ruled on the matter and set a national precedent.

Federal authorities understand that both the circuit and high courts are now weighted with conservative judges. “It may be better to retreat and to live to fight another day sometime in the future when, hopefully, the politics are less intensely against us,” Jarvis said.

He worried about what the turnabout implies about the appeals court. “This looks terrible. The optics are absolutely awful, because you expect federal courts, and particularly federal appellate courts, to know what they are doing and not look like Keystone Cops. This flip-flop, with no explanation against a backdrop of spiking COVID numbers? I mean,” he said.

An underlying current here may be all the would-be cruise passengers who opt to depart from a port other than those in Florida, Alabama, and Georgia, so as to help ensure their own health safety. Will this result in an economic impact that could have damaging political repercussions for the right wing in those states?

Hopefully.

On a different planet:
California requires vaccines, tests for teachers and staff

California will become the first state in the nation to require all teachers and school staff to get vaccinated or undergo weekly COVID-19 testing, as schools return from summer break amid growing concerns about the highly contagious delta variant, Gov. Gavin Newsom announced Wednesday.

The new policy applies to both public and private schools and will affect more than 800,000 employees, including about 320,000 public school teachers and a host of support staff such as cafeteria workers and cleaners, the state Department of Public Health said. It will also apply to school volunteers....

California’s two largest teachers unions, both powerful political allies to the governor, said Wednesday they fully supported Newsom’s policy.

The California Teachers Association and the California Federation of Teachers both cited state and national polling that indicates nearly 90% of educators have been vaccinated but said the rising spread of the delta variant, particularly among children, makes the new policy necessary. Children under 12 are not yet eligible to be vaccinated.

“Educators want to be in classrooms with their students, and the best way to make sure that happens is for everyone who is medically eligible to be vaccinated, with robust testing and multi-tiered safety measures,” CTA President E. Toby Boyd said in a statement.

While Hawaii Gov. David Ige announced last week that all Department of Education staffers would be required to disclose their vaccination status or face weekly testing, California’s order is far more sweeping, applying to all staff who work in both public and private schools in the country's most populous state.

Over the past few weeks, Newsom has mandated that all health care workers must be fully vaccinated and required that all state employees get vaccinated or choose weekly testing. The weekly testing schedule is based on guidance from the Centers for Disease Control and Prevention.

For schools, Newsom had already issued a mask mandate that applies to teachers and students. But until Wednesday, he had left the decision of whether to require vaccines up to local districts.

Vaccine mandates are perilous for the Democratic governor, who faces a recall election next month fueled in part by anger over his handling of the pandemic....

Students can't block Indiana University vaccine mandate -U.S. Supreme Court's Barrett

U.S. Supreme Court Justice Amy Coney Barrett on Thursday denied a bid by students at Indiana University to block the school's requirement that they be vaccinated against COVID-19.

Barrett rejected the students' emergency request without offering any explanation and without referring the matter to the full court for review. The decision marks an early test of vaccine mandates during a period of surging infections and hospitalizations caused by the Delta variant of the coronavirus....

Hundreds of colleges and universities have mandated the COVID-19 vaccine, as have some private employers. The students' case presents one of the first challenges to the legality of these mandates.

In July, U.S. District Court Judge Damon Leichty in South Bend, Indiana, sided with the school, finding the policy "isn't forced vaccination." On Aug. 2 the Chicago-based 7th U.S. Circuit Court of Appeals also rebuffed the students, noting that vaccine requirements are common.

"A university will have trouble operating when each student fears that everyone else may be spreading disease," the appeals court said.
Barrett was 45SHOLE's final SCOTUS appointee.

Yes, it's a gutsy but entirely appropriate move on Newsom's part. I hope it helps him beat the recall. The last thing this state needs is a RWNJ governor.

But it could set a new record for veto overrides by the Dem majority state legislature.

Meanwhile just saw on the local evening news that the leading plurality candidate, Larry Elder, is promising to toss out Newsom's vaccine and mask mandates if he gains the governor's mansion.

What a fool.

If Elder wins, maybe Alabama wouldn't be such a bad move after all.

(Just kidding. I'd rather move to Oregon, Vermont, or IDK, Virginia, or any other number of Dem governed states)

Straka is accused of urging the crowd on Jan. 6 to seize a shield from a Capitol Police officer as rioters attempted to push their way into the building. Straka told them, “Take it away from him,” according to a court affidavit. He yelled, “Take it! Take it!”

“We’re going in. They’re saying we’re going in. We’re going in,” Straka appeared to say at another point as he stood outside the doors of the Capitol, according to a video obtained by law enforcement agents.

Straka has a hearing scheduled for Aug. 25.

Miami Herald Shreds Ron DeSantis Over Latest Vaccine Claim: 'Profile In Selfishness'

... DeSantis claimed last week — as his state continued to experience a surge in the highly contagious delta variant ― that receiving the shot is “about your health and whether you want that protection or not” and “doesn’t impact me or anyone else.”
:wtf: :obscene-birdiered:
The newspaper’s board called out DeSantis — a prominent Donald Trump apologist and possible 2024 contender — for “dismissing the role of vaccines in reducing community spread.”

“Doesn’t impact anyone else? Talk about a profile in selfishness,” it wrote.

The role of the shots are actually “the opposite of what he says” because the spread of COVID-19 “is a community problem, and solving it starts with vaccines,” it continued.

DeSantis has already banned schools from mandating the use of face masks and fought cruise line companies requiring passengers to be vaccinated, the board noted.
