Good question. From what I got in the article, Ohio State people have been using that term "The" not just as part of the legal name, but separately as a nickname in and of itself. Like waving a flag with "The" on it. That's not really the same as just trademarking "The Ohio State University" and isn't even the same as saying, lower case the Ohio state university. So I'm guessing - guessing - that as long as sports merch at Miami uses "The U" in a generic way and doesn't emphasize "The", that they'll probably be OK. Of course, Miami students being such as they are, it wouldn't be surprising for some of them to come up with some way to mock OSU that could be a violation. "THE Pretenders" come to mind. I don't know.
