Probably is. Early on, he might have gotten rid of the filibuster and increased the number of justices when there was still some euphoria of getting rid of Trump. Now, the Trumpers hate him even more and the Dems and "Independents" are disillusioned and discouraged - at best.

Even without a confirmed Constitutional "right", Congress could fix the issue with federal legislation. But they won't, largely because Biden missed his window of chance to get rid of the filibuster. Consider if they had one that, what could have been passed by now that would be nationally popular. Instead, he's bogged down and doesn't even get credit for the popular infrastructure bill.
