Thomas Webster argued, unsuccessfully, that he attacked a police officer in self-defense on January 6.

Federal prosecutors are seeking the longest sentence yet for a Capitol rioter, asking the judge to give a former NYPD officer 210 months — seventeen and a half years — in prison.

Thomas Webster was found guilty on all six charges in May, including assaulting an officer and entering restricted grounds. His sentencing is set for September 1....

The criminal complaint describes Webster elbowing his way through the mob to be among those leading the charge against the Capitol police barricade, shouting at one officer: "You fucking piece of shit," and "you fucking commie fuck."

Webster also wielded a metal flagpole at the riot. The DOJ later released body camera footage of him repeatedly hitting the metal barrier next to the officer with it until it broke, the complaint said.

The footage then shows him tackling the officer to the ground and appearing to gouge the officer's eyes.

The former cop was wearing body armor and assaulted officers.

A federal judge has sentenced former New York Police Department officer Thomas Webster to 10 years in prison for assaulting officers outside the Capitol during the Jan. 6 riot.

The sentence is the longest prison term yet for a defendant in the Justice Department's criminal investigation of Jan. 6, but short of the 17.5 years prosecutors had sought for Webster....

Webster was convicted of assaulting, resisting or impeding an officer using a dangerous weapon; civil disorder; entering and remaining in restricted grounds with a dangerous weapon; engaging in physical violence in restricted grounds with a dangerous weapon; and engaging in an act of physical violence on Capitol grounds.

During his sentencing, Webster was given three years of supervised probation and ordered to pay $2,060 in restitution.

Judge Amit Mehta chose to apply a 4-level enhancement because Webster was wearing body armor. This alone added 30 months to the minimum sentence he could have received.

Oath Keepers Attorney Charged With Conspiracy In Jan. 6 Attack
Kellye SoRelle attended parking garage meeting with Oath Keepers head Stewart Rhodes and Proud Boys ex boss Enrique Tarrio night before storming of Capitol.

... Kellye SoRelle — general counsel for the antigovernment group — was arrested in Texas on charges including conspiracy to obstruct the certification of President Joe Biden’s electoral college victory, the Justice Department said.

SoRelle, 43, is a close associate of Stewart Rhodes, the Oath Keepers’ leader who is heading to trial later this month alongside other extremists on seditious conspiracy charges.

After Rhodes’ arrest in January, SoRelle told media outlets she was acting as the president of the Oath Keepers while he’s behind bars.

Prosecutors have accused Rhodes and his militia group of plotting for weeks to stop the transfer of power and keep former President Donald Trump in office, purchasing weapons, organizing military-style trainings and setting up battle plans.

SoRelle told The Associated Press last year — when FBI agents seized her phone as part of the Jan 6. investigation — that she had no knowledge of or involvement in the Capitol breach. She called the seizure of her phone “unethical” and the investigation “a witch hunt.”

... SoRelle is also charged with obstruction of an official proceeding, obstruction of justice for tampering with documents and a misdemeanor charge for entering Capitol grounds. The indictment says she persuaded others to destroy and conceal records sought by investigators....

A slew of its members have been charged in connection with Jan. 6. Three Oath Keepers have already pleaded guilty to seditious conspiracy, a rare Civil War-era charge that’s historically been hard to prove. They are also cooperating with the Justice Department.

Donald Trump incited an attack on the U.S. Capitol that resulted in five dead police officers and 140 more officers injured, and he is now under three criminal investigations, but that did not dissuade three dozen Pennsylvania state troopers from posing for a photo with the former president during his visit last weekend.

Trump on Sunday showed off the photo of him flashing a thumbs-up sign with rows of uniformed troopers on either side of him, a large sign and logo for the “Pennsylvania State Police, Troop P, Wilkes-Barre” directly behind him.

The night before, at a rally in Wilkes-Barre, he had attacked the FBI and the Department of Justice for investigating him. Just days earlier, he had said he would likely pardon all the Jan. 6, 2021, rioters, many of whom have been charged with assaulting police officers at the Capitol that day....

The photo, which Trump posted to his Twitter-like Truth Social platform without comment but in a series of photos and videos from his Saturday night rally, shows 31 officers in full uniform, three in black T-shirts and two men wearing suits. Trump is in the middle. None of the troopers is Black; two are women and it is unclear whether any are Latino.

“I didn’t see a lot of Black and brown faces in that photograph. People can draw their own conclusions, I guess,” Fanone said....

The Pennsylvania state troopers are not the only police officers to continue supporting Trump. Florida’s Palm Beach Police Department earlier this year held its annual major fundraiser at Mar-a-Lago, Trump’s social club in that town, putting hundreds of thousands of dollars into Trump’s personal cash registers, and it plans to do so again in January.

A year ago, the New Jersey State Police Benevolent Association held a fundraiser at Trump’s golf course in Bedminster, New Jersey, just two weeks after the New York Police Department’s 17th Precinct, a few blocks from his Trump Tower high-rise, welcomed him for a Sept. 11 photo opportunity....

The Justice Department is investigating efforts to overturn the 2020 election.

About 40 subpoenas were issued by the Justice Department last week as part of its criminal investigation into the Jan. 6 attack on the U.S. Capitol, sources familiar with the matter tell ABC News.

Among those subpoenaed are close advisers to former President Donald Trump, as well as former White House officials and staffers from his 2020 presidential campaign ranging from lower-level staffers to those at the highest levels of the campaign....

As ABC News has previous reported, the subpoenas are seeking information from witnesses about Trump's efforts to overturn the 2020 election, the events leading up to and surrounding the Jan. 6 attack, and the fundraising and spending efforts of the Trump-aligned Save America PAC.

We may have to wait for history to tell us whether a milquetoast Garland responded to citizen pressure - especially from billy.pilgrim ;) - or whether he's been methodically prepping for this moment all along. His is a memoir that I might actually read.
