US Supreme Court rejects challenge to Alaska campaign finance law

The U.S. Supreme Court declined on Monday to hear a challenge based on constitutional free speech protections to a voter-approved measure in Alaska that required greater public disclosure of certain political donations as the justices passed up a chance to further curtail campaign finance regulation.

The justices turned away an appeal by several Alaskan residents and advocacy groups, represented by a conservative legal group, of a lower court's ruling upholding the law narrowly approved as a ballot initiative in 2020.

The initiative, called Ballot Measure 2, adopted sweeping changes to the state's elections system. The plaintiffs objected to what they called some of the most stringent disclosure requirements in the United States on political donors....

A trial court judge handling the case declined to block the law's enforcement. The San Francisco-based 9th U.S. Circuit Court of Appeals Circuit upheld that ruling in March, saying the disclosure requirements were "reasonably tailored to the state's important interests in keeping the public informed."

Trump Executive Order Says States Must Use Voting Machines That Don’t Actually Exist

... It’s kind of ironic, because the whole mantra of Republicans when it comes to elections is states’ rights. When Democrats tried to pass the Freedom to Vote Act and the John Lewis Voting Rights Act a few years ago, you heard over and over from Republicans that states should run their own elections. Well, suddenly Trump is saying that states actually don’t have the power to run their elections and should be run based on the way he wants them to be run. That means he wants states to require all this new documentation that they didn’t need before, that they may have to change their deadlines for mail ballots, and that Elon Musk and co. can go searching through their state voter rolls. This is pretty dramatic in terms of what states are doing right now.

This is kind of a minor thing, but the funniest part of the executive order, to me, was that Trump was saying that states need to implement voting machines that don’t actually exist. Basically, he wants to ban voting machines that use QR codes or bar codes, which are used in places like Georgia and Wisconsin. Trump is saying, No, you have to use a different kind of machine, but those machines don’t actually exist. This order, in some cases, is actually asking states to do things that not only are illegal but are actually just impossible....

North Carolina judges side with colleague in Supreme Court election dispute over ballots

A North Carolina appeals court sided Friday with the trailing candidate in a close state Supreme Court election from November, ruling that tens of thousands of ballots were wrongly allowed in the tally. But they offered some of the voters a way to have their ballot count.

The 2-1 opinion by a panel of the intermediate-level Court of Appeals could eventually put Republican candidate Jefferson Griffin ahead of Democratic Associate Justice Allison Riggs. She currently leads in their race by 734 votes from over 5.5 million ballots cast.

The judges on Friday found that the State Board of Elections got it wrong in December when it dismissed Griffin's election protests. The ruling is expected to be appealed to the Supreme Court.

While The Associated Press declared more than 4,400 winners in the 2024 general election, the state Supreme Court election is the only race that is still undecided.

A federal judge on Thursday blocked major components of President Donald Trump's sweeping executive order seeking to overhaul U.S. election procedures, ruling that his administration likely overstepped constitutional boundaries.

Judge: Results of North Carolina court race with Democrat in lead must be certified

Disputed ballots in the still unresolved 2024 race for a North Carolina Supreme Court seat must remain in the final count, a federal judge ruled late Monday, a decision that if upheld would result in an electoral victory for Democratic incumbent Allison Riggs.

U.S. District Judge Richard Myers agreed with Riggs and others who argued it would be a violation of the U.S. Constitution to carry out recent decisions by state appeals courts that directed the removal of potentially thousands of voter ballots they deemed ineligible. Myers wrote that votes couldn't be removed six months after Election Day without damaging due process or equal protection rights of the affected residents.

Myers also ordered the State Board of Elections to certify results that after two recounts showed Riggs the winner - by just 734 votes - over Republican challenger Jefferson Griffin. Myers wrote that Griffin's formal protests after the election, which were rejected by the State Board of Elections, constituted efforts to make retroactive changes to the voting laws that would arbitrarily disenfranchise only the voters who were targeted by Griffin. Griffin's challenges over voters not providing photo identification only covered at most six Democratic-leaning counties in the state.

"You establish the rules before the game. You don't change them after the game is done," Myers wrote in a 68-page order.

"Permitting parties to ‘upend the set rules' of an election after the election has taken place can only produce ‘confusion and turmoil'" that "'threatens to undermine public confidence in the federal courts, state agencies, and the elections themselves,'" he added while citing other cases.

Democrats and voting rights groups raised alarm about Griffin's efforts. They called it an attack on democracy that would serve as a road map for the GOP to reverse election results in other states.

Monday's order "must bring an end - once and for all - to Republicans' attempts to overturn a free and fair election," Democratic National Committee Chair Ken Martin said.
