Yeah, I know - to keep saying the fault is on the law and not on the enforcers is just farting into the wind, but that doesn't mean it's not true. Back in 1986 when IRCA (Immigration Reform and Control Act) was passed and yes, that's a Reagan bill, employer began being required to have all new employees fill out the I-9 form. The I-9 requires the applicant to produce, and the employer to look at, various specified forms of identification and eligibility for employment. Sound reasonable, right? And enforcement was, maybe still is, vigorous with the fine to an employer for failing to get an I-9 about the same as actually hiring an undocumented person. But - big but - employers could not verify the credentials presented were real, nor were employers held responsible for accepting fake credentials. Soooooo - if you require those guys you picked up from in front of WalMart to fill out the I-9 and show you some paper, you're home free with the Immigration people. "Their credentials were fake?!! (clutching pearls) How can that be? I had no idea" Meanwhile you've got a year or so of work out of them before they (might) get caught in a Social Security number mismatch. A better solution back then, and a better solution now is to hammer the employers who hire undocumented workers, including putting them out of business if necessary, and find better ways to make immigrants in compliance. But then, if you solved your immigration "problem" you wouldn't have a political football, would you?

The law and/or the procedures are antiquated by modern standards, as well as the Social Security computer system.

And of course the entire issue is a skosh different.
