That's possible, of course. But then you have to rationalize the President of the United States invoking executive privilege to protect ATF employees who made a mistake. A bit better than the suggestion offered earlier in this thread that POTUS invoked executive privilege to protect low level ATF guys in Phoenix.
Or, it could have been political operatives trying to make the President's 90% lie come true, as discussed in July 2011.

To be sure, some legal U.S. guns make their way into Mexico, but the objective of the 90 percent exaggeration was to give the Obama administration cover to crack down on legal gun sales in the U.S. and resurrect the so-called assault weapons ban.
