MediaMatters: The New York Times' Deceptive Suggestion That Hillary Clinton May Have Violated Federal Records Law
Law Signed "Two Years After Clinton Stepped Down." Criticizing the Times article's insinuation that Clinton violated the law, Daily Banter contributor Bob Cesca pointed out: "The article doesn't say which federal regulation, though. Why? Perhaps because the federal regulations went into effect in late November, 2014 when President Obama signed H.R. 1233, modernizing the Federal Records Act of 1950 to include electronic communications. It was signed two years after Clinton stepped down."
[...]
Rep. Cummings: Even The 2014 Bill "Would Continue To Allow Employees To Use Their Personal Email Account For Official Business." Contrary to claims that Hillary Clinton violated the law by using personal email account while serving as Secretary of State, even a 2014 law that strengthened oversight of the use of personal email by government officials -- passed after Hillary Clinton had left the State Department -- still permitted government officials to use personal email.

That's interesting, and quite sad that the regulations weren't even in place until 2014. Doesn't look they're strong enough IMHO.rstrong wrote:MediaMatters: The New York Times' Deceptive Suggestion That Hillary Clinton May Have Violated Federal Records Law

I like Bernie, but he's too damn old.

IG: Some emails on Clinton's server were beyond top secret
Ut-oh.
banni saw the possibility 10 months ago, I wonder why more Dem potential POTUS aspirants didn't.

Re: Is Hilary done?
Failure to follow protocol in the protection of classified (no matter how high) information is pretty small potatoes in the world of political wrong-doing. Now, if they show she sent the information to somebody without the proper security clearance, it's worse, but not by much.
If they can show she intentionally disclosed information to, say, the Russians or somebody else who could use the information not in the US interests, then you've got something to hang her with. I seriously doubt they're going to find that.
Anyway, she could always say she was being a "whistleblower" and exempt herself from protection of the classified information

Re: Is Hilary done?
I wouldn't know, but the IG's opinion won't help her vulnerable campaign and any indictment will sink it. Plus, many Dems will reasonably wonder if the taint won't hurt her in November and may make their primary choices accordingly. It's already happening, she should be crushing Bernie and that she isn't is not just about policy differences (though I wish Dems were that left), it's about character.
... Clinton has said that she didn't send or receive information that was classified at the time via her personal email account.

Re: Is Hilary done?
The Bush II administration used Republican Party servers rather than those in the White House. You can be damn certain that it included a lot of top secret content too. Jeb! used his own server rather than State servers. A couple prominent Congressmen have claimed to have never used email - meaning that their lackeys did their emailing for them, exempting the mail from archiving rules.
The real question is, why was it standard practice for both parties to avoid government run servers?

Re: Is Hilary done?
Unless there's lot more unsaid, the IG ..."says some of the emails that former Secretary of State Hillary Clinton had on her home server were more sensitive than top secret." Not much of an offense there - so far.
I admit to being a Hillary fan for a long time, and used to say that I really voted for her in '92 and '96 even though Bill thought he was President. Having said that, however, I wouldn't refuse to toss her under the bus if she really did do something that could jeopardize continuing a Dem in the White House. (yes, we could argue whether giving the race to Bernie might jeopardize it or not, but still...) But it continues to amaze me how she gets dragged through the coals on minor crap related to doing her job pretty well while the whole list of clowns on the other side get free rides on seriously substantive deficiencies and sleaziness.

I'm amazed that Hillary - and Ted Cruz - have gotten as far as they have. As I said in July 2014:O Really wrote:But it continues to amaze me how she gets dragged through the coals on minor crap related to doing her job pretty well while the whole list of clowns on the other side get free rides on seriously substantive deficiencies and sleaziness.
Even in hindsight this seemed reasonable.Likewise neither Hillary Clinton nor Ted Cruz - the candidates getting the most press these days - are likely to be nominated in 2016. Both are placeholders. Magnets to attract all the hate and smears that the other party can throw at them, to keep the mud off more likely candidates. Come election time, someone with less baggage will be nominated in the primaries.
Obama was an unknown for most of the country at this point in the 2008 election cycle. That kept the mud off him, with most of it flung at Clinton. I think both sides have learned that lesson.

"the whole list of clowns on the other side get free rides on seriously substantive deficiencies and sleaziness" . . . from Republicans. Are you really that surprised?

Why Did Hillary Clinton Need a Private Server? The Answer Makes Bernie Sanders President
"Makes Bernie Sanders President" is probably hyperbole at this point, but the details and discussion of why it's a big deal is interesting.

Re: Is Hilary done?
This article's point can be summed up as "Hillary put ALL her email through her private server!!!" while trying to avoid saying "The previous administration, while it put the bulk of its email through their own private servers at the Republican Party headquarters, at least put a few emails through the White House server."

Re: Is Hilary done?
Read it again.
... Sorry Hillary supporters, nobody in State Department history has ever used a private server exclusively, or completely circumvented a State.gov email address....
Furthermore, it doesn't matter what the corrupt officials in Bush's White House did, their behavior shouldn't be the standard by which we judge Clinton.... the days of "Bush was worse" are over....

Read my post again.
And it was at a time when it was legal to do so, and arguably standard practice for both parties.
They're using a weasel-worded technicality: She put ALL her email through her private server, while the previous administration merely put MOST of it through their private servers. This article's point can be summed up as "Hillary put ALL her email through her private server!!!" while trying to avoid saying "The previous administration, while it put the bulk of its email through their own private servers at the Republican Party headquarters, at least put a few emails through the White House server."

Re: Is Hilary done?
Goodman has been beating up Hillary on behalf of Bernie for a while. And who knows - he may be right. But so far he didn't provide any insight into what he thinks the "answer" is that will bring her down. Suppose he really thinks it was to make the information easier for the Chinese to access?
BTW, I totally love his referencing a person who really did intentionally disclose volumes of clearly classified information in his commentary on Hillary who insofar as anybody has proven, has not.

An expert on cyber security is an expert, O Really, and Snowden's not the only one he cites.
I read it correctly the first time, rstrong. Your "trying to avoid" was inaccurate. You may not like the author's conclusion dismissing the comparison to Shrub, but he did address the matter. Also, your absolute certainty that "it was legal to do so" is disputed by the fact that there's an investigation. I'll wait on the report and possible charges.

A lawyer disbarred for stealing from his client is probably still an expert in his field, but I wouldn't cite him as an authority on fee structure or collections.Vrede too wrote:An expert on cyber security is an expert, O Really, and Snowden's not the only one he cites.

Ah, but you might cite him as an authority on criminal activity.
