"Should be..." sure, if we had a Supreme Court that valued precedent. An almost identical case in 1980 (Stone vs. Graham) shot down Kentucky's attempt to require the 10 commandments in classrooms with clear and unambiguous language. Scarily, though, that decision was only 5-4 and the current bunch seems to have no compunction in making it up as they go along, so who knows.

It seems to have become a universal right-wing strategy to do/pass something, knowing it's illegal, knowing it's likely to get overturned, knowing some judge will issue an injunction even before it goes into effect, and just don't care. They figure they'll get enough publicity, throw enough red meat to get value out of it anyway. Helluva way to run a country when those who are "leaders" have no respect for the fundamentals of law.

There really ought to be some way to exact penalties on government officials that pass stuff that is clearly unlawful. It's one thing to try to push the limit on an ambiguous or or conflicting interpretation law, but IMNVHO quite another to just ignore clear and settled law. I used to run into that a lot on labor issues, where an employer thought they could establish whatever policy they wanted and that if it were "policy" it didn't matter what the law was. When they got caught, consequences varied somewhat according to how the policy was developed:
(1) Did you seek legal advice before implementing this policy? If "yes", then penalty is lower.
(2) Did your lawyer approve this policy? If "yes", penalty may be waived, even if the lawyer was wrong
(3) If you did not seek advice, penalty is higher
(4) if your lawyer told you not to do it and you did it anyway, penalty is very painful

Gotta be some way to penalize government officials who ignore the law.
