The Trump administration’s claim that it can't do anything to free Kilmar Abrego Garcia from an El Salvador prison and return him to the U.S. “should be shocking,” a federal appeals court said Thursday in a blistering order that ratchets up the escalating conflict between the government's executive and judicial branches.
A three-judge panel from the 4th U.S. Circuit Court of Appeals unanimously refused to suspend a judge's decision to order sworn testimony by Trump administration officials to determine if they complied with her instruction to facilitate Abrego Garcia's return.
Judge J. Harvie Wilkinson III, who was nominated by Republican President Ronald Reagan, wrote that he and his two colleagues “cling to the hope that it is not naïve to believe our good brethren in the Executive Branch perceive the rule of law as vital to the American ethos.”

The seven-page order amounts to an extraordinary condemnation of the administration’s position in Abrego Garcia’s case and also an ominous warning of the dangers of an escalating conflict between the judiciary and executive branches the court said threatens to “diminish both.” It says the judiciary will be hurt by the “constant intimations of its illegitimacy” while the executive branch “will lose much from a public perception of its lawlessness.”

Judge Opens Criminal Contempt Proceedings Against Trump Officials
A federal judge said there is cause to hold the Trump administration in contempt over its failure to facilitate bringing back migrants from an El Salvador prison.
U.S. District Judge James Boasberg said there is cause to hold the Trump administration in criminal contempt for ignoring his orders over flights containing migrants who were sent to El Salvador.
In a lengthy ruling issued Wednesday, the judge said there was sufficient evidence to show a “willful disregard” by the administration of his orders in March that directed officials to halt the flight of more than 130 Venezuelan migrants to the CECOT prison in El Salvador without any due process. The administration sent the migrants amid Trump’s invocation of the Alien Enemies Act....
“The Constitution does not tolerate willful disobedience of judicial orders — especially by officials of a coordinate branch who have sworn an oath to uphold it,” Boasberg wrote.
Allowing officials to “freely annul” court orders would make a “solemn mockery of the Constitution itself,” he added.
Typically, criminal contempt involves fines or imprisonment. Boasberg’s order was mum on which avenue he would consider. He did, however, reveal that should he prosecute the officials for criminal contempt, he would take one of two paths.
Federal rules for criminal procedure state that contempt proceedings can be prosecuted by an attorney for the government. Should the Justice Department refuse or decline to assign someone to prosecute the case, then Boasberg said he would appoint an outside attorney to do it....

I read a story this morning that says Stephen Miller made the statement on a Fox News program that "we won the Supreme Court case" when in reality it was a unanimous decision against the administration. This is what I mean when I mention the amount of damage Fox has done to this country.....broadcasting stuff totally opposite from reality.

Senate Bill 4-C, the law used to detain U.S.-born citizen Juan Carlos Lopez-Gomez, was used to arrest more than a dozen other people.
On Wednesday, 20-year-old U.S.-born citizen Juan Carlos Lopez-Gomez was arrested in Florida and charged with illegally entering the state as an “unauthorized alien.” He was detained even after his mother presented his birth certificate and Social Security card in court, a harrowing indication that even citizens are not safe from the Trump administration’s anti-immigration agenda.
Although headlines focused on the absurdity of charging a U.S. citizen with illegal entry, there was another potentially unlawful element of his arrest: On April 4, weeks before his arrest, a federal judge paused enforcement of Senate Bill 4-C, the state law used to detain him....

Williams extended the initial 14-day temporary restraining order until April 29 and clarified that the order applied to anyone tasked with enforcing the law. She warned that arresting people pursuant to a law that had been blocked from being enforced could constitute “false imprisonment,” Tilley said. It is unclear how many additional arrests have been made throughout the state (at least 15).
